     On 22 October 1805, Joseph Daughtry filed a Billl of Complaint against Joel Daughtry, Josiah Daughtry, Elizabeth Daughtry, and Nancy Daughtry. A second bill of complaint in April 1806 stated that in 1795 Joseph Daughtry coveyed land to Samuel Daughtry his brother to secure a debt. Land consisted of 200 acres on the north side of Little Swamp on a prong of the Tyancokey River. The said Samuel died without settling the said security and Joseph brought suit against the four infants of the deceased.1

     Mary Parker was born circa 1773 at North Carolina.1,2 Mary married first Samuel Daughtrey Jr., son of Samuel Daughtrey [Sr.] and Elizabeth Williams.3 She married second Robert Lawrence, son of Charles Lawrence and Amey Joyner. Mary died on 10 October 1852 at Tennessee.1,4 She was interred at Stratton Cemetery at Sumner Co., Tennessee.4

     The will of Mary Lawrence mentions "son Henry Daughtry and his children Richard Henry Daughtry, George Ann Daughtry, William Thomas Daughtry. My children Joel H. Daughtry, Elizabeth Stratton and Nancy Barnes. Granddaughter Penelope Horn Daughtry. Request burial in graveyard in land owned by nephew Thomas P. Horn.1

     Josiah probably died before 1821.2

Narrative

     The will of Josiah has not been located but there are deeds of disposition of the 200 acres he inherited from his father Samuel. A third of the land went to each of siblings Nancy, Joel, and Elizabeth. Neither Mary wife of Samuel or Henry son of Mary were inherited any of the land. This would seem to indicate that Josiah was not a son of Mary and was probably a son of Samuel by a previous wife. Also it would seem to indicated that Henry was not a son of Samuel and thus did not share in the disposition of the land inherited by Josiah from his father Samuel. The deeds of disposition of Joshiah's land provided in an email from Joani Taylor2 are as follows:
